terms & conditions
1. scope of application
these terms apply to all orders placed by customers through the online shop of alapfy manufactura. for consumers (b2c), statutory regulations apply. for entrepreneurs or legal entities (b2b), these terms apply to all current and future business relations.
2. conclusion of contract
the presentation of products in our online shop does not constitute a legally binding offer but a non-binding online catalog. by clicking the "buy" button, you place a binding order for the products in your shopping cart. the contract is concluded when we accept your order by sending an order confirmation via e-mail.
3. bespoke & custom orders
products manufactured based on individual specifications (bespoke/custom orders) are excluded from the right of withdrawal. this contract is binding upon order confirmation.
4. prices and payment
all prices stated are in euros and include the statutory value-added tax (vat) where applicable. payment is due immediately upon conclusion of the contract. we accept the payment methods offered during the checkout process.
5. shipping and delivery
we ship to the addresses specified during checkout. delivery times are estimates.
for consumers (b2c): the risk of accidental loss or damage transfers to the customer upon delivery of the goods.
for entrepreneurs (b2b): the risk of accidental loss or damage transfers to the customer upon handover of the goods to the shipping provider.
6. retention of title
the goods remain the property of alapfy manufactura until full payment has been received. for b2b customers, this extends to all claims arising from the current business relationship.
7. warranty and liability
for consumers (b2c):
the statutory warranty rights apply to all products purchased. alapfy manufactura is liable for damages resulting from injury to life, body, or health, and for other damages based on intentional or grossly negligent breach of duty.for entrepreneurs (b2b):
warranty claims of the buyer presuppose that the buyer has duly complied with their statutory obligations to inspect the goods and report defects pursuant to § 377 HGB (German Commercial Code). if a defect becomes apparent later, it must be reported immediately upon discovery. alapfy manufactura is liable for damages resulting from injury to life, body, or health, and for other damages based on intentional or grossly negligent breach of duty. beyond this, any liability for indirect, consequential, or financial damages (such as loss of profit) is excluded.
8. applicable law and jurisdiction
these terms and conditions are governed by the laws of the federal republic of germany. the place of jurisdiction for all disputes arising from the contractual relationship is our registered place of business (alling/germany), provided the customer is a merchant (b2b).
9. final provisions
should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected.
cancellation policy
1. right of withdrawal (consumers only)
only consumers (private individuals) have the right to withdraw from this contract within 14 days without giving any reason. entrepreneurs (b2b) are excluded from this right. the withdrawal period expires 14 days after the day on which you acquire physical possession of the goods.
2. exclusion of custom orders
the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are manufactured based on an individual choice or specification (bespoke or custom-made products). such products are excluded from return and refund.
3. exercise of right
to exercise your right, you must inform us of your decision to withdraw from this contract by a clear statement.

4. effects of withdrawal
we will reimburse all payments received from you for the goods, including standard delivery costs, not later than 14 days from the day we are informed of your decision to withdraw. we expressly reserve the right to withhold the reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
5. inspection & return condition
reimbursement is strictly contingent upon our inspection of the goods upon arrival. returned goods must be in their original, unused, and undamaged condition.
6. liability for diminished value
you are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. if goods are returned in a used, damaged, or altered condition, we will deduct the corresponding value loss from your reimbursement.
